WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. AI-GENERATED ANALYSIS MAY CONTAIN ERRORS OR OMISSIONS. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 10PAL AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR INVESTMENT LOSSES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that violates these Terms or is harmful to us, other users, or third parties. Upon termination, your license to use the Service ends immediately. Provisions that by their nature should survive termination (disclaimers, limitations of liability, indemnification) will do so.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding individual arbitration under the rules of the American Arbitration Association. You waive the right to participate in class actions. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction.
